These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the inkoop.autos website and services operated by Inkoop.autos ("we", "us", or "our").

• "Vehicle" refers to any automobile, car, truck, or other motor vehicle that is the subject of our recycling and acquisition services.
• "Content" refers to text, images, photos, audio, video, and all other forms of data or communication.
• "Customer" refers to any User who submits a vehicle for recycling, sale, or valuation through our Service.

3. use of service

3.1 eligibility

You must be at least 18 years of age and possess the legal authority to enter into these Terms and to use the Service in accordance with these Terms. By using our Service, you represent and warrant that you meet these requirements.

3.2 user accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3.3 prohibited activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any purpose that is illegal or prohibited by these Terms.
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
• Using the Service in any manner that could disable, overburden, damage, or impair the Service.
• Impersonating or attempting to impersonate another User, person, or entity.
• Collecting or tracking the personal information of other Users.
• Engaging in any automated use of the system, such as using scripts to send comments or messages.
• Uploading or transmitting viruses, malware, or other types of malicious code.
• Attempting to bypass any measures of the Service designed to prevent or restrict access.

4. vehicle submission and valuation

4.1 vehicle information

When submitting a vehicle for recycling, sale, or valuation, you agree to provide accurate, complete, and current information about the vehicle, including but not limited to its make, model, year, condition, mileage, and any damage or mechanical issues.

You represent and warrant that you are the legal owner of the vehicle or are authorized by the legal owner to submit the vehicle for recycling, sale, or valuation.

4.2 valuation and offers

Any valuation or offer provided by Inkoop.autos is based on the information provided by you and is subject to verification upon physical inspection of the vehicle. We reserve the right to adjust or withdraw any offer if the vehicle's actual condition differs from the information provided.

All offers are valid for the period specified in the offer. If no period is specified, the offer is valid for 7 days from the date of issuance.

4.3 vehicle collection

If you accept our offer, you agree to make the vehicle available for collection at the agreed time and location. You must provide all necessary documentation, including but not limited to the vehicle registration document, proof of identity, and any other documents required by law for the transfer of ownership.

6. intellectual property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Inkoop.autos and its licensors. The Service is protected by copyright, trademark, and other laws of both the Netherlands and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Inkoop.autos.

You retain all and any rights that you have on content that you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, translate, and distribute such content in any and all media or distribution methods.

7. limitation of liability

To the maximum extent permitted by applicable law, in no event shall Inkoop.autos, its affiliates, directors, employees, agents, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, Inkoop.autos assumes no liability or responsibility for any:

• Errors, mistakes, or inaccuracies of content.
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Service.
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.
• Any interruption or cessation of transmission to or from the Service.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party.

8. indemnification

You agree to defend, indemnify, and hold harmless Inkoop.autos, its affiliates, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service.
• Your violation of any term of these Terms.
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
• Any claim that your Content caused damage to a third party.

9. governing law and dispute resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

In case of disputes, we will first try to resolve them through good faith consultation. If this is not possible, disputes may be submitted to the competent court in the Netherlands.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

10. termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

11. changes to terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
